  • Introduction

    We are committed to providing access to all users. Although we continue to test and modify our site for accessibility, there may be some legacy pages that are not fully compliant with our standards. If you have problems accessing this website, pleaseemail our Support staff.

  • Access Keys

    Most Web browsers offer an alternative way of following navigation links by using keyboard access keys. To use an access key when using Windows, hold down the Alt key and press the appropriate access key. For Macintosh users, hold down the Control key and press the appropriate access key. Internet Explorer may require you to use the Enter key to activate the link. To return to the home page, the access key is Alt+1.

    All links throughout SHAW.ca use the first letter of the link as its access key. As an example, pressing Alt+A activates the link to the About Us section. If a page has multiple links starting with the same letter, you can move through the available options by holding down the Alt key while pressing the access letter key.

  • Skip Navigation Form
    SHAW.ca allows people with screen reading software to jump from the top of the page to the main content of the page. This feature is available through access key Alt+X.
  • Images
    All content images used on Shaw.ca are accompanied by alternative text captions describing the image if your browser supports the alt-text function. Decorative graphics have blank alt-text attributes.

    At Shaw, we have more than 10,000 helping hands working to bring exceptional experiences to our customers. We love hearing your great Shaw stories (thanks for those!), but we also want to know if you have a concern, complaint or suggestion for how we can improve. Here's how we make sure your thoughts and concerns are quickly addressed:

    • Contact Customer Care – Our team is available to you 24/7/365 through email, phone (1-888-750-7429) or at our retail locations. Our friendly team will work diligently towards finding a solution to your concern in a timely manner.
    • Local Customer Care Management - we're here with a helping hand, several hands, in fact! If a solution can't be found with our customer care team, then our local management team is available to help. Your Customer Care representative can put you in touch with a local Manager.
    • FurtherAssistance, Telephone and Internet Concerns – an agency independent of Shaw, called the Commissioner of Complaints and Telecommunications Services (CCTS) is also available if we can't find a resolution to your concern.
      CCTS is an a gency independent of the telecommunications industry, whose mandate is to resolve complaints of individual and small business retail customers about their telecommunications services. If you have a complaint about your services, including local or long distance telephone service, wireless telephone service, or Internet service, you must first try to resolve it directly with your service provider. If you have done so and have been unable to reach a satisfactory resolution, CCTS may be able to help you, free of charge.

    Shaw provides you with the following convenient payment alternatives:

  • Terms of Payment
    The services you subscribe to are payable by the due date indicated on your bill. Payments made after the statement date on your bill will be reflected on your next bill. Amounts owing after the due date are subject to a late payment interest charge calculated on the outstanding amount at 2% per month (26.8% per year) until paid in full. If your account remains unpaid for 60 days you agree to pay a processing fee of $20.00 for services relating to down-grading or terminating your services. Overdue accounts are subject to termination of the services by Shaw. You agree to pay Shaw $25.00 if your credit card is denied or if your cheque is returned due to non-sufficient funds. Should it become necessary to disconnect a past due account, payment of the full outstanding balance plus a reconnection charge will be required before service is restored, provided Shaw is not under any obligation to restore the services to any person who continues to fail to make timely payment of the amounts due.

Acceptable Use Policy - Internet

    Thank you for choosing Shaw's Internet Services!

    These terms and conditions are in addition to Shaw's Terms of Service.
    By using Shaw's Internet Services and such services(collectively, the "Services") provided by Shaw Cablesystems G.P., its partners and associates (collectively, "Shaw"), you agree to the following terms of this Acceptable Use Policy, including the General terms contained below:

    This Acceptable Use Policy constitutes the agreement between Shaw ("Shaw" or "our") and the customer ("you" or" your") subscribing to the Services. This Acceptable Use Policy governs your use of the Services and any devices and/or equipment used to support the Services, including without limitation, a cable modem and software used in conjunction with the Services which is loaned to you from Shaw for your use solely in connection with the Services (collectively, the "Equipment"). By activating the Services, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with terms and conditions of Shaw's Terms of Services (collectively, the "Agreement"). If you do not wish to be bound by this Agreement or any modifications, which may be made by Shaw from time to time (as described in the following paragraph), do not activate or use the Services and immediately contact Shaw.

    Shaw may revise this Agreement and provide notice of such material changes to you by sending you an electronic mail message at your Shaw email address. Such changes shall be deemed effective upon the electronic communication being retrievable by you. YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION SENT TO YOU AND POSTED ONLINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICES AFTER YOU ARE NOTIFIED OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY SUCH CHANGES. If you do not agree with any of the amendments to this agreement, you agree to stop using the Services and to provide notice to Shaw of your termination of this Agreement in accordance with the terms of the Terms of Service. Shaw customers should consult this document regularly to ensure that their usage conforms to the most recent version. In the event of conflict between any customer agreement and this Agreement, the terms of this Agreement will govern.   • About Shaw Internet

    Shaw provides a variety of Internet Services to residences and businesses. The Shaw High-SpeedLite Internet™, Shaw High-Speed Internet™, Shaw High-Speed Extreme™, Shaw High-Speed Warp™ and Shaw High-Speed Nitro™ Internet Services allow residential customers to connect to the Shaw high-speed backbone network, and the Internet. Shaw Point of Sale Connect, High-Speed Extreme, and Business High-Speed Internet allows businesses to connect to the Shaw high-speed backbone network, and the Internet for the purposes of transacting business.

    The Services use resources that are shared with many customers. Moreover, the Services provide access to the Internet which is used by millions of others. Each user benefits by being able to share resources and communicate almost effortlessly with other members of the user community. However, as with any community, the benefits and privileges available from the Services, and the Internet in general, must be balanced with duties and responsibilities designed to guarantee uniform access to all customers of the Services.

    Use of the Services is subject to the following rules and guidelines. You are responsible for ensuring that the use of all Services provided to you comply with this Agreement.

  • Illegal Activity

    Use of the Services for any activity that violates Local, Provincial, Federal or International law, order or regulation, is a violation of this Agreement. Prohibited activities include, but are not limited to:

    1. Posting, storing, transmitting or disseminating unlawful material, including without limitation, child or other pornography, any content, data or other material which is libelous, obscene, hateful, unlawful, threatening, reaction or ethnically offensive, defamatory or which in any way constitute or encourages conduct that would constitute a criminal offense.
    2. Disseminating material which violates copyright or intellectual property rights. The customer assumes all risk regarding whether material is in the public domain;
    3. Pyramid or other illegal soliciting schemes; or
    4. Fraudulent activities; including but not limited to: impersonating any person or entity, or forging anyone's digital or manual signature.
  • Security

    You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services.

    The Services may not be used to breach the security of another user, or to attempt access to anyone's computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools is strictly prohibited.

    YOU MAY NOT DISRUPT THE SERVICES. The Services also may not be used to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to crash a host. The transmission or dissemination of any information or software which contains a virus or other harmful feature is also strictly prohibited.

    YOU ARE RESPONSIBLE FOR THE SECURITY OF ANY DEVICE YOU CONNECT TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, DATA STORED ON THAT DEVICE. In particular, Shaw recommends against enabling file or printer sharing of any kind. Shaw recommends that any files or services you make available for remote access be password protected.

  • Inappropriate Content

    Shaw is not responsible for any content you post, store, transmit, disseminate or access through use of the Services. Any content questions or complaints you may have regarding content you accessshould be addressed to the content provider.

    You are responsible for information published to the Web or other Internet services, through your account. Shaw reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it, at its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful.

    Shaw has no obligation to monitor transmissions made on the Services. However, Shaw has the right to monitor such transmissions and to disclose the same in accordance with Shaw's Privacy Policy. By using the Services to publish, transmit or distribute content, a user is warranting that the content complies with this Agreement and licenses and authorizes Shaw to reproduce, publish, distribute and display such content worldwide.

  • Electronic Mail

    Shaw limits the number of email messages that you can send through the Services using Shaw's email servers in a 24 hour day. Shaw defines an email message as one message sent to one recipient. For example: a single message addressed to three recipient email addresses would count as three email messages. Shaw High-Speed Internet, High-Speed Lite Internet, High Speed Extreme Internet,High Speed Warp Internet and High-Speed Nitro Internet are limited to 1000email messages per 24 hour day and no single email message can be addressed to more than 99 recipient email addresses. ShawHigh-Speed Internet, ExtremeInternet, and Business Internet are limited to 1000 email messages per 24 hour day and no single email message can be addressed to more than 400 recipient email addresses.

    The Services may not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages may be sent only to those who have explicitly requested them.

    The Services may not be used to collect responses from unsolicited email sent from accounts on other Internet hosts or email services which violates this Agreement or the acceptable use policy of any other Internet service provider. Moreover, unsolicited email may not direct the recipient to any Web site or other resource which uses the Services.

    Forging, altering or removing electronic mail headers is prohibited. However, you may insert additional characters into your from: and reply-to: addresses in order to prevent your true address from being automatically added to the mailing lists used by bulk emailers. In this case, your true address must remain obvious to any human viewer. For example, you may substitute nospam.john.smith for john.smith.

    You may not reference Shaw, Shaw Lite-Speed Internet or Shaw High-Speed Internet (e.g. including Organization: Shaw High-Speed Internet in the header, or by listing an IP address that belongs to Shaw) in any unsolicited email, even if that email is not sent through Shaw. Shaw owns all IP addresses and email usernames for all Services.

    Mail Bombing is prohibited. You may not send numerous copies of the same or substantially similar messages, nor may you send very large messages or files to a recipient with the intent to disrupt a server or account. The propagation of chain letters is prohibited, whether or not the recipient wishes to receive such mailings.

    Shaw is not responsible for the forwarding of email sent to any account which has been suspended or terminated. Such email will either be returned to sender, ignored, deleted, or stored temporarily, at Shaw's sole discretion.

  • Newsgroups

    Messages posted to newsgroups must comply with the written charters or Frequently Asked Questions ("FAQs") for those newsgroups. Advertisements, solicitations, or other commercial messages may be posted only in those newsgroups whose charters or FAQs explicitly permit them. You are responsible for determining the policies of a given newsgroup before posting to it.

    Posting or cross-posting the same or substantially similar messages to more than 9 newsgroups is prohibited. Our news software will automatically cancel any messages posted to 9 or more newsgroups.

    Binary files may not be posted to newsgroups not specifically named for that purpose.

    Forging, altering or removing header information is prohibited. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.

    Shaw reserves the right to discontinue access to any Usenet newsgroup at any time and for any reason.

    You may not flood or disrupt Usenet newsgroups. Disruption is defined as posting a large number of messages to a newsgroup which contain no substantive content, to the extent that normal discussion in the group is significantly hindered. Examples of disruptive activities include, but are not limited to: posting multiple messages with no text in the body, posting many follow-ups to messages with no new text.

    Messages may not be cancelled, except by the author or by official newsgroup moderators performing their duties.

    The Usenet news service included with a Shaw account is provided for interactive use by you, using a commonly-available NNTP client such as NETSCAPE COMMUNICATOR or OUTLOOK EXPRESS. Non-interactive clients that download Usenet articles in bulk are prohibited.

  • Internet Relay Chat

    The Services may be used to participate in Chat discussions hosted by Shaw servers, third party servers, or may not involve servers at all. In all cases, Shaw does not monitor the contents of the discussion and is not liable for the content of any communications made via Internet Chat.

    The Services may not be used for Chat flooding. Flooding is defined as deliberately repeating actions in quick succession in order to fill the screens of other Internet users with text.

    Any computer or other device connected through the Services may not maintain more than 2 simultaneous chat connections. This includes the use of automated programs, such as bots or clones. Automated programs may not be used when the account holder is not physically present at the device.

    The Services may not be used to send messages which disrupt another Internet user's equipment, including software, hardware and user display. The Services may not be used to access any chat server in violation of this Agreement of that server. The Services may not be used to manipulate any chat server in order to harass or disconnect other Internet users, or to gain privileges which have not been authorized.

    You are not permitted to use the Services to connect to chat servers or channels from which you have been banned.

    The Services may not be used to continue to send chat messages to an Internet user who has indicated their desire to not receive messages.

  • Bandwidth, Data Storage and Other Limitation

    You must comply with the current bandwidth, data storage and other limitations on the Services.

    You must ensure that your activity while using the Services does not improperly restrict, inhibit or degrade any other customer's use of the Services, nor represent (in the sole judgment of Shaw) an unusually large burden on the network itself, such as, but not limited to, peer to peer file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. The guidelines for Bandwidth Usage/month for each service package are the following: Shaw High-Speed Lite, 30 gigabytes; Shaw High-Speed Express, 60 gigabytes; Shaw High-Speed, 125 gigabytes; Shaw Extreme, 250 gigabytes; Shaw Warp, 400 gigabytes; Shaw Nitro, 500 gigabytes; Broadband 50, 400 gigabytes; Broadband 100, 500 gigabytes; Broadband 100+, 750 gigabytes; Unlimited Lite, unlimited data; Unlimited Express, unlimited data; Unlimited 100, unlimited data; Point of Sale Connect, 10 gigabytes; Server Connect, 200 gigabytes; Business Internet 25, 110 gigabytes; Business Internet High-Speed, 70 gigabytes; Business Internet Starter, 125 gigabytes; Business Internet 25, 250 gigabytes; Business Internet 50, 500 gigabytes; Business Internet 50 Plus, 750 gigabytes; Business Internet 100 Plus, 1 terabyte (all bandwidth is based on combined download and upload). The guidelines for acceptable website traffic include two gigabyte/month for High-Speed, Extreme and Business hosting packages. Shaw reserves the right to set specific limits for Bandwidth Usage and charge for excessive Bandwidth Usage for residential Services at any time. In addition, you must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede Shaw's ability to deliver the Services and monitor the Services, backbone, network nodes and/or other network services.

    UNDER NO CIRCUMSTANCES WHATSOEVER ARE YOU PERMITTED TO RESELL, SHARE, OR OTHERWISE DISTRIBUTE THE SERVICES OR ANY PORTION THEREOF TO ANY THIRD PARTY WITHOUT THE WRITTEN CONSENT OF SHAW AND PAYMENT OF APPLICABLE FEES. For example, you cannot provide Internet access to others through a dialup connection, host shell accounts over the Internet, provide email or news service, or send a news feed unless express permission is granted by the customer agreement.

    The residential Shaw Services are designed for personal Internet use. You may not use the residential Shaw Services for commercial purposes. You may not run a server in connection with the Shaw Services nor may you provide network services to others via the Shaw Services. Examples of prohibited servers and services include but are not limited to mail, http, ftp, irc, dhcp servers, and multi-user interactive forums. Some business services may be exempt from these limitations.

  • Traffic Management Policies

    Shaw uses traffic management policies to ensure proportional access to its network for all Shaw Internet customers. Some Peer-to-Peer (P2P) applications used for non real-time file sharing can consume a disproportionate amount of upstream bandwidth causing disruption to other customers on Shaw's network. Shaw's traffic management policies were introduced to quickly address any upstream congestion caused by these P2P applications while standard network expansion activities are undertaken to increase the bandwidth availability for all users.

    Shaw's traffic management policies come into effect only if upstream network congestion occurs on a network segment. If congestion occurs, the traffic management policies reduce the amount of upstream bandwidth available for P2P applications completing non real-time file transfer activity to 80 kbps per end-user.

    Shaw's traffic management policies do not affect download speeds and will not affect real-time interactive activities such as on-line gaming, banking, e-mail or VoIP services. For the majority of Shaw customers the Internet experience is unaffected by our traffic management policies and both upstream and downstream bandwidth will be available to ensure the full operation of any application.

    The traffic management policies implemented by Shaw use IP addresses to make real-time traffic management decisions in relation to Shaw's network. Since IP addresses have the potential to be linked to an individual's customer account, IP addresses could be considered personal information. The traffic management policies implemented by Shaw do not involve capturing, storing or archiving this information in any way.

  • Violation of this Agreement

    Shaw does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, Shaw will respond appropriately if it becomes aware of inappropriate use of the Services. Although Shaw has no obligation to monitor the Services and/or the network, Shaw reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and Shaw Internet customers.

    Shaw prefers to advise customers of inappropriate behaviour and any necessary corrective action. However, if you use the Services in a way which Shaw, in its sole discretion, believes violate this Agreement, Shaw may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. Shaw will not have any liability for any such responsive actions. The above described actions are not Shaw's exclusive remedies and Shaw may take any other legal or technical action it deems appropriate.

    Shaw reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on Shaw's servers and network. During an investigation, Shaw may suspend the account or accounts involved and/or remove material which potentially violates this Agreement.

    You hereby authorize Shaw to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include Shaw providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in Shaw's Privacy Policy.

    Upon termination of your account, Shaw is authorized to delete any files, programs, data and email messages associated with such account.

    The failure of Shaw to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

    You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.

  • General

    1. Customer Computer It is your responsibility to ensure that your computer equipment meets the requirements set out by Shaw as may be amended from time to time, that are necessary to use the Services.
    2. Relocating Cable Modem You agree not to relocate Shaw's cable modem within your premises without notifying Shaw, so that Shaw may schedule a mutually agreeable time to undertake such work.
    3. Personal Pages You may create personal pages on our World Wide Web Server (the "Site"). On the Site, you can conceive, design, create, maintain, and publish texts, diagrams, illustrations, audio clips and related materials for access by a global audience. You warrant that the content on your Site is suitable for publication, is not libelous or defamatory, does not breach the intellectual property rights (including, without limitation, copyright) of any third party, and complies with all laws, regulations, court orders and other legal requirements. While it is your responsibility to regulate and control all content on the Site, Shaw may decide to suspend or delete your home page without your consent if you violate this Agreement. In addition, if Shaw determined that it is appropriate, Shaw may either. i) issue a warning to you; ii) suspend your access to some or all of the Services; or iii) terminate this Agreement, inclusive of your access and use of the Services.
    4. Ownership of Addresses Shaw owns all addresses provided to you, including but not limited to IP addresses, e-mail addresses and personal Web page addresses. SHAW MAY MODIFY OR CHANGE SUCH ADDRESSES AT ANY POINT IN TIME AND SHALL IN NO WAY BE REQUIRED TO COMPENSATE YOU FOR SUCH CHANGES.
    5. End User Licenses You agree to comply with the applicable terms and conditions of all end user license agreements accompanying any software or plug-ins to such software distributed in connection with the Service. All such end user licenses will terminate upon termination of this Agreement. In the event of an inconsistency between the terms of this Agreement and any such license, the terms of this Agreement shall prevail.
    6. Multiple Users You acknowledge that you are executing this Agreement on behalf of all persons who use the Services through your computer. You assume all liability for such use of the Services and are responsible for ensuring that all such other users understand and comply with the terms and conditions of this Agreement.
    7. No License; Intellectual Property of Shaw and Others Nothing within the Services or any additional services offered by Shaw from time to time or through any Shaw Web site shall be construed as conferring any license of Shaw's or any third parties' intellectual property rights, whether by estoppel, implication, waiver, or otherwise. You acknowledge and agree that Shaw's Web sites, the Services and/or additional services offered by Shaw from time to time are protected by copyright, trademark, patent, or other proprietary rights. No portion of the Services or Shaw's Web sites are affiliated with or endorsed by Microsoft, America Online or ICQ Inc. The mark MSN Messenger is owned by Microsoft; the mark Instant Messenger and AOL Instant Messenger are service marks of America Online; the mark ICQ is a registered mark of ICQ Inc.; other marks not identified herein are the property of their respective owners. Acceptable Use Policy - Phone

    Thank you for choosing Shaw'sHome Phone Services!

    These terms and conditions are in addition to Shaw's Joint Terms of Service.

    By using Shaw's Phone Service and such other services related thereto (collectively, the "Service") provided by Shaw Telecom G.P. or its partners and/or associates (collectively, "Shaw"), whether you are a residential phone subscriber ("Residential Phone") or small business/home office phone ("Business Phone") subscriber, you agree to the following terms of this Acceptable Use Policy:

    This Acceptable Use Policy constitutes the agreement between Shaw ("Shaw" or "our") and the customer ("you" or" your") subscribing to the Service. This Acceptable Use Policy governs your use of the Service and any devices and/or equipment used to support the Service, including without limitation, a telephone adapter and software used in conjunction with the Service which is loaned to you from Shaw for your use solely in connection with the Service (collectively, the "Equipment"). By activating the Service, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with the terms and conditions of Shaw's Terms of Services and Privacy Policy (collectively, the "Agreement"). If you do not wish to be bound by this Agreement or any modifications, which may be made by Shaw from time to time (as described in the following paragraph), do not activate or use the Service and immediately contact Shaw.

    Shaw may change portions of this Agreement from time to time upon reasonable notice to you. Shaw will post notice of any changes made to the Agreement on line at Shaw.ca by setting the last date of revision on the top right hand corner. Shaw may also advise you of such changes by sending you an electronic mail message at your user address or mailing notification through Canada post to the address shown on your account with Shaw. All changes will take effect within 30 days of the date of being posted. If you do not have access to the Internet you may contact Shaw at any time to obtain a printed copy of this Agreement. YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION POSTED ONLINE OR SUPPLIED TO YOU BY SHAW TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICE AFTER CHANGES ARE POSTED CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY THE POSTED CHANGES.
  • Uses and Restrictions
    1. Shaw Residential Phone Service (Home Phone, Home Phone Lite, Home Phone Basic, or as may be further branded by Shaw from time to time): You may only use the Service from your phone(s) located at your residence. The Services are required to be connected to Shaw's Equipment and used only for normal residential calling purposes such as person to person conversations or voice messages.
      You may not use the ShawHome Phone Service for:
      1. Non-residential use (example: the Service cannot be used to operate a business, including, without limitation a home based business whether or not the business is for profit or any other commercial purpose whatsoever);
      2. Data, fax, internet access, a call centre, call back, call sell (telemarketing), auto dialer, bulk faxing or debit card services;
      3. Illegal, fraudulent or improper purposes, criminal offences, intellectual property infringement, harassment (including annoying or offensive calls/transmissions); or
      4. Any purpose intended to cause interference with Shaw's network operations or the Services, including the fair and proportionate use of the Services by others, as determined by Shaw, in its sole discretion, from time to time.
      5. Additionally, you may not use the Shaw Residential Phone Service for:
      6. Chat lines, multi-party lines, long-distance calls made using call forwarding and three-way calling features, multi-party conference calls, free conference calling services, or party lines or calls to pay-per-call services which impose unusually high costs on Shaw; or
      7. Sustained and excessive use of the Service in a manner which is materially inconsistent with average residential usage patterns to make unlimited long distance calls directed to or within certain high cost of service areas, as determined and designated as such by Shaw, in its sole discretion, from time to time.
    2. Shaw Business Phone:You may only use the Service from your phone(s) located either at your small office or at the home office within your residence. The Services are required to be connected to Shaw's Equipment and used only for normal business calling purposes such as person to person conversations or voice messages.
      You may not use the Shaw Business Phone Service for:
      1. Data, fax, internet access, a call centre, call back, call sell (telemarketing), auto dialer, bulk faxing or debit card services;
      2. Illegal, fraudulent or improper purposes, criminal offences, intellectual property infringement, harassment (including annoying or offensive calls/transmissions); or
      3. (c) Any purpose intended to cause interference with Shaw's network operations or the Services, including the fair and proportionate use of the Services by others, as determined by Shaw, in its sole discretion, from time to time.
      4. Additionally, you may not use the Shaw Business Phone Service for:
      5. Chat lines, multi-party lines, long-distance calls made using call forwarding and three-way calling features, multi-party conference calls, free conference calling services, or party lines or calls to pay-per-call services which impose unusually high costs on Shaw; or
      6. Sustained and excessive use of the Service in a manner which is materially inconsistent with average small home office/business usage patterns to make unlimited long distance calls directed to or within certain high cost of service areas, as determined and designated as such by Shaw, in its sole discretion, from time to time.


      You are solely responsible for the use of the Residential Phone or Business Phone Services by you and other users, including all calls originating from your telephone(s), as well as for all charged calls accepted at your telephone(s), regardless of who made or accepted them. You agree that any unlimited long-distance calling available on your Service is only available for calls within Canada and to the U.S., with the exception for calls made in and to NWT area code 867, Hawaii area code 808, and Alaska area code 907, or such other calling areas as identified and designated by Shaw on its website, in its sole discretion, from time to time. You also agree that calls to multi-party conference services, party lines, adult services, or to high cost pay-per-call services may be restricted by Shaw, it its sole discretion, from time to time. Calls terminating outside of the applicable calling area for your Service, as identified and designated by Shaw in its sole discretion from time to time, are subject to higher rates. YOU ARE REQUIRED TO CONTACT SHAW BEFORE YOU USE ANY MEDICAL MONITORING DEVICES THROUGH THE SERVICE. Other restrictions may apply to the Service and a Shaw representative will advise you of those, if any, at the time you subscribe to the Service.

      You agree to: (a) take all necessary measures to ensure that the Shaw Phone Services are used in accordance with this Agreement; and (b) be liable for all consequences resulting from any breach of this Agreement. Your abuse or misuse of all or any part of the Service or breach of any term contained in this Agreement may cause all or any part of the Service to be restricted, blocked, suspended, downgraded or terminated by Shaw (refer to Shaw's Terms of Service for details regarding termination of the Service). Shaw may also refuse, at any time and without liability, to provide any of the Services to you where Shaw would have to incur unusual expenses such as, but not limited to, the payment of high costs to other telecommunication carriers. Shaw may, but shall not be obligated to provide such Services if, upon Shaw's request and agreement, you agree to pay an amount for these unusual expenses. Agreements on such matters shall be in writing and signed by you and Shaw.

  • Service Interruptions
    Shaw does not warrant uninterrupted use of the Service. You understand that it is your responsibility to ensure that the telephone(s) you use with the Service are compatible with the Equipment. Most importantly, some telephone(s) may not operate if there is a power failure and if you are using a telephone that requires power to operate you would lose your ability to use the Service, including access to 9-1-1 emergency services until the power is restored. In addition, and in accordance with the Terms of Service, a power failure or disruption in the Service may require Shaw to reset or reconfigure the Equipment prior to you utilizing the Service.
  • Re-Sold Service
    Where re-sold telephone service is being provided to you by Shaw as all or part of the Service:
    1. maintenance for the local and long distance telephone service may be provided by parties other than Shaw; and
    2. all local and long distance telephone services may be subject to the terms and conditions imposed by the primary service provider (including applicable tariffs) with respect to the Service. Shaw reserves the right to transfer re-sold local phone service as a Shaw local service.
  • Automatic-Dialing Announcing Devices
    Shaw enforces all Canadian Radio-television and Telecommunications Commission rules on Automatic - Dialing Announcing Devices ("ADAD") and unsolicited voice and facsimile calls made for the purposes of solicitation. The use of ADAD to make unsolicited calls for the purposes of solicitation, used to place calls to emergency lines or healthcare facilities is strictly prohibited. If you violate these restrictions or those posted by the Canadian Radio-television and Telecommunications Commission Shaw may terminate the Service immediately.
  • Directory Service
    1. Your name, address and telephone numbers will be published in the telephone directory for your area. Unless you contact Shaw to advise you do not wish your information to be published in the telephone directory.
    2. In the case of errors or omissions in your, name, address and telephone number in the directory listings, whether or not the error or omission is with regard to telephone numbers, addresses, individual names or business names, Shaw is only responsible to provide you a refund or credit of any charges associated with the listings in question for the period during which the error or omission occurred.
  • Provision of 9-1-1 Access
    1. You may use the Service to receive access to emergency services through the 9-1-1 service provider. The emergency 9-1-1 fee charged by the Municipality may be billed by Shaw each month as part of your monthly charge for the Service or may be billed directly to you by the Municipality.
    2. If there is a suspension or termination of the Service, including as a result of a power failure, all features of the Service, including emergency 9-1-1 service, may be suspended or terminated.
  • Hearing Impaired Assistance
    1. You will have access to Hearing Impaired Assistance services through the Service to assist you in placing calls, to or from persons who use a telecommunications device for the deaf ("TDD") machine or a text based form of message relay service using the Internet ("IP Relay Service"). Hearing Impaired Assistance operators will be available to assist you in making calls to deaf, hard-of-hearing, and speech impaired customers by relaying messages between TDD / IP Relay Service users and conventional phone users. Long distance charges will apply where applicable.
    2. In order to use IP Relay Services you must first register with Shaw's IP Relay Services Web Site. You will also need to be resident in an area where Shaw offers the service, have an Internet access service, and provide compatible end user equipment for use with the IP Relay Services.
    3. The IP Relay Services is for individual use only, and does not permit you to place collect call, 900 pay-per-call, bill to third party, casual calls and calls to satellite phones using the IP Relay Service and to any other types of calls, which Shaw notifies you as being prohibited, from time to time.
    4. The IP Relay Service is not designed for emergency calls, nor should it be used as a substitute for enhanced 9-1- 1 services. Should you utilize the IP Relay Services to make a call to the 9-1-1 services, you acknowledge and agree that:
      1. In regard to a call to the emergency telephone number (9-1-1), use of the IP Relay Services may result in account address information being delivered to the emergency services dispatch centre via the IP relay provider's network;
      2. The use of the account address information in association with the IP Relay Service could result in calls appearing to originate from a location other than your current location;
      3. If, in dispatching the emergency services in response to a call to 9-1-1, reliance is placed on the address information associated with your Shaw account and received by the IP relay provider's network in conjunction with the call to 9-1-1, emergency services may not be routed to the location from which the call to 9-1-1 originated;
      4. In regard to a call to 9-1-1, you or any person using the IP Relay Services is responsible to provide complete and accurate information relating to the actual location of the emergency situation to the emergency services call operator; and
      5. Without restricting any indemnities set forth in Shaw's Joint Terms of Service, you are responsible and shall indemnify Shaw for, and hold Shaw harmless from and against, all charges, losses, costs, liabilities and damages of any kind whatsoever related to emergency services being dispatched to a location other than the location from which the call to 9-1-1 originated as a result of:
        1. Any use by you of the IP Relay Services that results in the address information for your Shaw account being a location other than the location from which the call to 9-1-1 originated; or
        2. The failure by you or any person using the IP Relay Services or any services used in conjunction with the IP Relay Services to respond, or provide complete or accurate information, to a 9-1-1 or emergency call operator requesting a response or information in order to properly dispatch emergency services; or
        3. The failure by you to provide Shaw with current and accurate information location; or
        4. Any use by of the IP Relay Services after cancellation, termination or suspension of your Shaw phone services.
  • Ownership of Numbers
    Shaw owns all numbers provided to you including all telephone numbers and calling card numbers. Shaw may be required to modify or change such numbers at any point in time and will in no way be obligated to compensate you for such changes.
  • Security Codes
    You are responsible to maintain the confidentiality of any security codes to your voice mail or other accounts.
  • Equipment, Installation, Maintenance and Return Responsibilities
    1. Shaw will install the Equipment within your home. The Equipment will be supplied to you by Shaw solely for your use of the Service and will at all times remain the property of Shaw. You may use the Equipment only at the address you have indicated to Shaw at the time you subscribe to the Service. You are responsible to advise Shaw if your address is changing. If you move to a location outside of the area served by Shaw, this Agreement shall be terminated and you must return to Shaw all Equipment. Kindly refer to the Terms of Services for complete details regarding your obligations as they pertain to Shaw Equipment.
    2. You are responsible to supply at your cost all telephones required for your use of the Service, including without limitation, the supply of all medical and security monitoring devices, fax, including the wiring inside your home which is required to connect to the Service. Shaw has no obligation to maintain or repair any facilities or equipment owned by you. You are responsible to maintain your own equipment at your own cost. Shaw is not responsible if your equipment is not compatible with the Equipment or the Service or if your equipment interrupts or causes interference with the Service or if it causes the Service to fail for any reason whatsoever.
  • If You are Moving
    If you move premises within Shaw's serving area and you wish to transfer the Service, including your current telephone number, to the new premises, you must give Shaw a minimum of fifteen (15) calendar days advance notice by calling our Customer Service Department at 1-888-472-2222 or your local Shaw branch at the address shown in the Contact Us section of our Web site Shaw.ca. You may only transfer your telephone number within the same exchange area. The ability to transfer the Service to the new premises is dependant on the availability of the Service at the new location. If sufficient advance notice is not received, Shaw may not be able to provide the Service on the date of your relocation.
  • Confidentiality

    Shaw may disclose any information as is necessary to:

    1. satisfy any legal, regulatory or other governmental request;
    2. operate the Service properly; or
    3. protect Shaw or its customers, in accordance with the guidelines set out in Shaw's Privacy Policy;

    For the purpose of the Service, Shaw may be required to disclose your name, address and listed telephone number to: - another telephone company, provided the information is required for the efficient and cost-effective provision of telephone service and disclosure is made on a confidential basis with the information to be used only for that purpose; - a company involved in supplying you with telephone or telephone directory related services, provided the information is required for that purpose and disclosure is made on a confidential basis with the information to be used only for that purpose; or - an agent retained by Shaw in the collection of your account, provided the information is required for and is to be used only for that purpose.

Terms of Use - Shaw Go WiFi

  • Introduction

    By accessing and using the Shaw Internet WiFi ("Shaw Go WiFi") provided by any of Shaw Cablesystems G.P., Shaw Telecom G.P. or its or their partners and/or associates (collectively, "Shaw"), you agree to the following terms and conditions of service, which incorporate by reference the Shaw Joint Terms of Use, Shaw Acceptable Use Policy, and Shaw Privacy Policy terms and conditions available at www.shaw.ca (collectively, the "Terms of Use ").

    You agree that Shaw may, for any reason, and without notice to you, modify or terminate Shaw Go WiFi and these Terms of Use without liability to you, any user or any third party. If you do not wish to be bound by these Terms of Use or any modifications which may be made by Shaw from time to time, do not access or use Shaw Go WiFi and immediately contact Shaw.

    YOUR NONTERMINATION OR CONTINUED USE OF SHAW GO WIFI AFTER THE EFFECTIVE DATE OF ANY CHANGES MADE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF USE AS MODIFIED BY SUCH CHANGES.

  • Access to and Use of Shaw Go WiFi
    You understand that Shaw Go WiFi is a feature of Shaw's Internet service and that you must be a current subscriber to a Shaw Internet service in order to use Shaw Go WiFi. As with other Shaw services, you are permitted to use Shaw Go WiFi only for lawful purposes.

    In order to access Shaw Go WiFi, you must provide your Shaw userid, password and certain other information ("Shaw Go WiFi ID") that may be requested from time to time. Shaw may also automatically collect certain information, such as MAC address, device location and device type, in order to provide you services and improve your service experience. You acknowledge and agree that you will be responsible for all activities during any session using Shaw Go WiFi under your Shaw Go WiFi ID. You may not provide any third party with your Shaw Go WiFi ID for the purpose of accessing Shaw Go WiFi. You remain responsible for all bandwidth usage incurred utilizing your Shaw Go WiFi ID as well as any account changes that may be imposed as a result of your bandwidth usage as set out in the Terms of Use, and agree to pay any applicable fees charged to your account for the use of Shaw Go WiFi, plus any applicable taxes and other fees imposed as a result of these Terms of Use.

    You may use Shaw Go WiFi solely for your own lawful personal purposes. You may not in any way distribute, resell or otherwise provide third parties with access to or use of Shaw Go WiFi.
  • Performance of Shaw Go WiFi
    In order to use Shaw Go WiFi, you must have a Wi-Fi capable device that:

    1. meets Canadian and other applicable technical standards;
    2. is compatible with Shaw Go WiFi;
    3. renders web pages in a standard HTML browser application;
    4. runs the IP protocol; and
    5. is configured to obtain IP addresses automatically.

    The Wi-Fi device must be in close enough proximity to Shaw Go WiFi wireless access points to achieve connectivity with the Shaw Go WiFi network. Shaw Go WiFi access location lists and maps may be updated from time-to-time. Actual Shaw Go WiFi coverage, locations and quality may vary.

    Shaw will endeavour to provide useful and reliable Shaw Go WiFi services, but you acknowledge that Shaw Go WiFi utilizes public, unlicensed radio-frequency spectrum. As such, Shaw Go WiFi is subject to external interferences, environmental influences, and other factors and variables beyond Shaw's reasonable control. Performance and availability may vary, including but not limited to or affected by,

    1. transmission and download speed and accuracy;
    2. network congestion;
    3. performance, configuration, and functionality of your Wi-Fi devices and wireless cards (including, but not limited to memory, storage and other limitations);
    4. physical obstructions and distances between your WiFi device and the Shaw Go WiFi network;
    5. availability of electric power;
    6. collocation failures;
    7. transmission and equipment limitations, failures, maintenance or repair; and
    8. user error.

    Shaw Go WiFi may also be interrupted, refused, limited or curtailed for these reasons. Shaw is not responsible for data lost or misdirected due to these and other foreseeable and unforeseeable factors. Network speed is an estimate and is no indication of the speed at which your Wi-Fi device or Shaw Go WiFi will operate. Actual network speed and other performance will vary.

    In order to maintain acceptable levels of service for all Shaw Go WiFi customers and to improve this service, Shaw reserves the right to monitor use of Shaw Go WiFi and to make such adjustments to the use of such services as necessary to maximize the benefit and enjoyment for all Shaw Go WiFi customers. Additionally, the Shaw Go WiFi service may use automated processes to monitor and scan communications over the Shaw Go WiFi network in order to maintain and provide services, improve your experience, ensure the integrity of your communications, convey messages related to your Shaw Go WiFi account, deliver relevant advertising and for various other purposes related to the provision of Shaw Go WiFi services. By using the Shaw Go WiFi service, you acknowledge and consent to Shaw's automated processing of your communications through the Shaw Go WiFi network, including information such as your IP or MAC address, Shaw Go WiFi ID, device location, HTTP requests and other information related to the provision of this service.
  • Service Subject To Interception and Unauthorized Use
    You acknowledge that communications over the Shaw Go WiFi network may be subject to interception by unauthorized third parties. Although Shaw uses commercially reasonable efforts to provide you with a secure and reliable service, your use of Shaw Go WiFi is "AS IS" and "AS AVAILABLE" and Shaw cannot and does not make any general or specific warranties regarding the security, availability, performance or other functionality of Shaw Go WiFi. You are responsible for implementing your own security protections while using Shaw Go WiFi. In the event you become aware of any unauthorized use of Shaw Go WiFi or any other security breach (including but not limited to third-party use of your Shaw Go WiFi ID and password), you agree to immediately notify Shaw. Shaw expressly disclaims any responsibility or liability for your use of Shaw Go WiFi and for any lack of security that may result from your use of Shaw Go WiFi. You agree to hold Shaw harmless for the loss of any file, data or other information while using the Shaw Go WiFi services, and for any unauthorized access to or utilization by any third party of any of your personal, financial, or other sensitive information.
  • Marketing and Shaw's Use of Wi-Fi Data
    You understand and agree that Shaw may from time to time use location or other data generated from your use of Shaw Go WiFi to deliver general or user specific messaging or advertising from Shaw or a third party to the browser you are using to access the Internet. Furthermore, you understand and agree that the Shaw Go WiFi "watermark" bearing Shaw's logo may appear superimposed from time to time over portions of website pages you visit, that the watermark is intended solely to identify Shaw Go WiFi as the source of your wireless Internet access service, and that this in no way indicates Shaw's approval of or responsibility for the content of such websites, which are solely the responsibility of the website operators and/or content providers. You agree that you will not seek to hold Shaw responsible in any way for any third party website content or the operation of any third party website accessed via Shaw Go WiFi, or for the appearance of our Shaw Go WiFi "watermark" over a portion of any website.

Change Management - Shaw Business

  • Introduction

    This is a Schedule to the Shaw Business Service Agreement (Appendix) and is incorporated into and forms part thereof. This policy will outline the process for change management activities for services provided by Shaw Business to its valued customers.

  • Change Management Policy

    Change activities are defined as any request to perform maintenance or to alter established services. A change can be initiated by Shaw Business or the customer.

  • Shaw Business Initiated Changes

    In order to upgrade, expand, repair and maintain our network, we may be required to schedule an event that may impact your service. We define two types of change control events:


    1.1. Scheduled Maintenance


    Scheduled Maintenance shall mean any maintenance activities planned during a standard Maintenance Window, which will be service impacting, or may pose a threat to the provided service. Customers shall be notified of any Scheduled Maintenance a minimum of 15 business days in advance of the planned activity. In each case we review and organize the technical procedures to minimize the disruption to your service. Our Network Operations Center tracks each event to conclusion.


    Shaw Business Standard Maintenance Window

    00:01AM-06:00AM local time (Sunday - Preferred)


    Our notification will be emailed to the change release contacts provided during the implementation process. Changes to customer contacts should be emailed to clientservices@shawbusinesssolutions.ca


    Notification will include impacted circuit identifier, date, time, expected duration, planned activity description and a ticket number. A response is not required, however any inquiries may be made by reply to the email notification or by calling the Shaw Business Network Operations Center at 1-866-244-7475 or noc@shawbusinesssolutions.ca


    1.2 Emergency Maintenance


    On occasion Shaw Business may need to react quickly to address an emergency issue on the network. Emergency Maintenance shall mean any maintenance which cannot be performed during as Scheduled Maintenance. Emergency Maintenance activities may occur outside of Standard Maintenance Windows, without notification, and may be service affecting. Emergency maintenance is undertaken with the intent of minimizing the overall impact to our customers. Our Network Operations Center tracks each event to conclusion.

  • Customer Initiated Changes

    We understand that our customers may need to make changes to their service.


    2.1 Requesting Service Changes


    Customers may request changes to an established service by emailing clientservices@shawbusinesssolutions.ca


    The request should include:


    • BPSO
    • Required date
    • Scope of work
    • Contacts
    • Assigned security code (mandatory)

    The customer is solely responsible for the safekeeping of the security code and Shaw Business will take no responsibility for the abuse thereof, including but not limited to fraud and other forms of misrpresentation. If you have experienced changes in personnel, please inform us immediately at the above email address to initiate the process of changing your security code.


    Client Services will acknowledge receipt of requested change within 24 business hours. Each change will be reviewed with technical operations, engineering and your Account Executive. Client Services will then confirm change activity with customer, including completion date and provide change fees, if applicable, for approval prior to proceeding with change.


    A Customer approved change will engage the change administration process and be billed according to the change management policy and, if applicable, any additional costs incurred for materials and/or labour.


    Standard fees;

Business Voice Acceptable Use Policy - Shaw Business

  • Introduction

    This Acceptable Use Policy ("AUP") governs the customer's use of business voice services provided by Shaw Business (the "Service" or "Services") and any devices and/or equipment used to support the Service, including without limitation, any equipment or software used in conjunction with the Service which is loaned to customer from SB for customer's use solely in connection with the Service (collectively, the "Equipment").


    SB may amend this AUP from time to time and will update the revision date on the AUP posted on line atwww.shaw.ca/sbsto indicate when changes have been made. All changes will take effect within 30 days of the date of being posted. CUSTOMER'S CONTINUED USE OF THE SERVICE AFTER CHANGES ARE POSTED WILL BE DEEMED ACCEPTANCE OF THE AMENDED AUP.

  • Uses and Restrictions

    Customer may only use the Service from customer's equipment located at customer's service location as specified in the applicable service appendix signed by customer and SB. The Services are only to be used for normal business calling purposes such as person to person conversations or voice messages.


    Customer is solely responsible for use of the Service provided to it by SB, regardless if such use occurred without the customer's consent or knowledge.


    Customer may not use the Service for any applications which exceed the network resources for which customer has contracted for under the applicable Service Appendix by more than 120%


    The Service may not be used for any activity that violates any local, provincial, federal, international or other applicable law or regulation.


    If SB believes, in its sole discretion, that a violation of this AUP has occurred (whether direct or indirect), it may take any responsive action it deems necessary, including suspending or terminating the Services.


    Customer abuse or misuse of the Service or breach of any term contained in this AUP may result in the Service being terminated by SB.


    CUSTOMER IS REQUIRED TO CONTACT SB BEFORE USING ANY MEDICAL MONITORING DEVICES THROUGH THE SERVICE.

  • Service Interruptions

    SB does not warrant uninterrupted use of the Service. Customer is responsible to ensure that any customer provided equipment used with the Service is compatible with the Equipment and the Service. Most importantly, some equipment may not operate if there is a power failure, resulting in customer losing the ability to use the Service, including access to 9-1-1 emergency services until the power is restored. A power failure or disruption in the Service may require SB to reset or reconfigure the Equipment prior to customer being able to utilize the Service.

  • Re-Sold Service

    Where re-sold telephone service is being provided to customer by SB, as all or part of the Service: (i) maintenance for the local and long distance telephone service may be provided by parties other than SB; and (ii) all local and long distance telephone services may be subject to the terms and conditions imposed by the primary service provider (including applicable tariffs) with respect to the Service. SB reserves the right to provide re-sold local phone service as a SB local service.

  • Automatic-Dialing Announcing Devices

    SB enforces all Canadian Radio-television and Telecommunications Commission rules on Automatic- Dialing Announcing Devices ("ADAD") and unsolicited voice and facsimile calls made for the purpose of solicitation. The use of ADAD to make unsolicited calls for the purpose of solicitation, or to place calls to emergency lines or healthcare facilities is strictly prohibited. If customer violates these restrictions or those posted by the Canadian Radio-television and Telecommunications Commission SB may terminate the Service immediately.


    The same restrictions that apply to ADAD apply to unsolicited voice and facsimile calls made for the purposes of solicitation. Persons placing unsolicited voice or facsimile calls to solicit are to ensure that an individual's request not to be called again is respected. The individual's name and telephone number must be removed from calling lists within 30 days of receipt of the request.

  • Directory Service
    1. Customer's name, address and telephone number(s) will be published in the telephone directory for customer's area unless customer contacts SB to advise it does not wish its information to be published in the telephone directory.
    2. In the case of errors or omissions in customer's name, address or telephone number(s) in the directory listings, whether or not the error or omission is with regard to telephone number, address, individual or business name, SB is only responsible to provide customer a refund or credit of any charges associated with the listings in question for the period during which the error or omission occurred.
  • Provision of 9-1-1 Access
    1. Customer may use the Service to receive access to emergency services through the 9-1-1 service provider. The emergency 9-1-1 fee charged by the municipality may be billed by SB each month as part of customer's monthly charge for the Service or may be billed directly to customer by the municipality.
    2. Emergency 9-1-1 service will not be accessible during any suspension or interruption of the Service, including as a result of a power failure.
  • Hearing Impaired Assistance
    1. Customer will have access to Hearing Impaired Assistance services through the Service. Hearing Impaired Assistance operators are available to assist customer in placing calls to or from persons who use a telecommunications device for the deaf ("TDD") machine. Long distance charges may apply.
    2. Hearing Impaired Assistance enables customers to communicate with deaf, hard-of-hearing, and speech impaired individuals by relaying messages between TDD's and conventional phone users.
  • Alternate Billing Format

    Upon request, SB will provide invoices in an alternate format for the visually impaired.

  • Credit and Security Deposit

    SB reserves the right to examine your credit records at any time, whether before or after providing the Services.

  • SB's Liability

    SB shall not be liable for:


    1. any interruption or unavailability of the Services, including, without limitation, any interruption or unavailability of emergency 9-1-1 service;
    2. any act or omission of any third party including, but not limited to, any other local telephone company, any connecting carrier or underlying carrier or other provider of connections, facilities or services;
    3. your conduct, acts or omissions;
    4. SB's failure, for any reason, to activate the Services on the activation date requested;
    5. any defacement of, or damage to, your premises resulting from the attachment of any instruments, apparatus or associated wiring and/or the Equipment furnished by SB, or removal thereof, when such defacement or damage is not wholly caused by SB's negligence; - See more at: http://business.shaw.ca/Acceptable-Use-Policy#sthash.zhJpUY48.dpuf
  • Telephone Numbers

    SB reserves the right to modify or change telephone numbers, if such change is required by the Canadian Numbering Association or any other governing body responsible for regulating telephone numbers in Canada. In the event SB is required to modify or change any telephone number, SB will not be liable to compensate customer for any costs resulting from such changes.

  • Security Codes

    Customer is solely responsible to maintain the confidentiality of any security codes for customer's voice mail or other accounts.

    Equipment Installation, Maintenance and Return Responsibilities


    1. SB may install the Equipment within customer's premises. The Equipment supplied by SB to customer is to be used solely for use of the Service and will at all times remain the property of SB.
    2. Customer is responsible to supply, at its sole cost and expense, all telephones required for customer's use of the Service, all medical and security monitoring devices, fax machines, and any wiring inside customer's premises which is required to connect to the Service. SB has no obligation to maintain or repair any facilities or equipment owned by customer. It is customer's responsibility to ensure that any customer supplied equipment is compatible with the Equipment and Service provided by SB, and customer will be solely responsible if its equipment interferes with or causes the Service to fail for any reason whatsoever.
  • Customer Relocation

    If customer relocates its office within SB's serving area and customer wishes to transfer the Service, including customer's current telephone number(s), to the new premises, customer must give a minimum of thirty (30) business days advance notice to SB' customer service department at 1-866-550-7429. Customer may only transfer telephone number(s) within the same rate center. The ability to transfer the Service to customer's new premises is dependent on the availability of the Service at the new location and access to the building. If sufficient advance notice is not received, SB may not be able to provide the Service on the date of customer relocation.

  • Confidentiality

    SB may disclose information as may be required to: a) satisfy any legal, regulatory or other governmental request; b) operate the Service properly; or c) protect SB or its customers, in accordance with the guidelines set out in SB's Privacy Policy, posted on its website at www.shawbusinesssolutions.com.


    Unless a customer provides express consent, or disclosure is pursuant to a legal power, all information kept by SB regarding the customer, other than the customer's name, address and listed telephone number(s), is confidential and may not be disclosed by SB to anyone other than: a) the customer; b) a person who, in the reasonable judgment of SB, is seeking the information as an agent of the customer; c) another telephone company, provided the information is required for the efficient and cost-effective provision of telephone service and disclosure is made on a confidential basis with the information to be used only for that purpose; d) a company involved in supplying the customer with telephone or telephone directory related services, provided the information is required for that purpose and disclosure is made on a confidential basis with the information to be used only for that purpose; or e) an agent retained by SB in the collection of the customer's account, provided the information is required for and is to be used only for that purpose.


    In order to provide customers with greater control over their privacy, SB offers the following privacy enhancing features: Name and Number Display, Name and Number Block, Last Call Return and Call Trace. All of these features may not be available to every customer, and if available, some restrictions may apply. Data Acceptable Use Policy - Shaw Business

  • Introduction

    The benefits and privileges available from Shaw Business ("Shaw Business") and the Internet in general, must be balanced with duties and responsibilities so that other users can also have a productive, enjoyable experience. This Acceptable Use Policy (the "Policy") was designed to prevent unacceptable uses of our services and equipment as well as to ensure that we are able to provide the level and quality of services that our customers expect. Each customer of Shaw Business is responsible for ensuring that the use of all services provided to such customer complies with this Policy.


    If Shaw Business believes, in its sole discretion, that a violation of this Policy (direct, or indirect, including violations by a third party) has occurred, it may take responsive action. Shaw Business is entitled to remove the offending material, establish immediate or temporary filtering, deny access, suspend or terminate Shaw Business Services, or take any other appropriate action, as determined by Shaw Business, in addition to any remedies provided by any agreement to provide Shaw Business Services.


    Shaw Business may investigate incidents involving violations of this Policy, and such violations may subject the customer to civil or criminal liability. In the event of a criminal violation Shaw Business will co-operate fully with law enforcement.


    The customer is solely responsible for use of their Shaw Business account, regardless if such use occurred without the account holder's consent or knowledge.


    Shaw Business may amend this policy at its sole discretion. The continued use of Shaw Business services after an amended policy has been posted here will be deemed as acceptance of the amended policy.

  • Prohibited Activities

    Illegal/Criminal Activity


    Shaw Business services must not be used for any activity that violates any local, provincial, federal, international or any other applicable law or regulation, including the distribution or storage of materials that are contrary to any applicable law or regulation. Prohibited activities include, but are not limited to:


    • Infringing copyrights, trademarks, trade secrets, patents or any other type of intellectual property;
    • Posting any content that threatens, advocates, promotes or otherwise encourages violence or which provides instruction, information or assistance in causing or carrying out such violence;
    • Transmitting offensive materials including obscene, pornographic, indecent, hateful, defamatory or otherwise objectionable material; and
    • Violating the personal privacy of another individual.

    Security Violations


    Shaw Business services must not be used to breach the security of any account, network, service, or other system of Shaw Business, or to gain unauthorized access to another network or system. Other security breaches include, but are not limited to:


    • Attempting to gain access to any other person's computer, software or data, without their knowledge or consent;
    • Circumventing user authentication or security of any host, network or account ("cracking" or "hacking");
    • Interfering with service to any user, host or network ("denial of service attacks") including, but not limited to, mail bombing, flooding of networks, deliberate attempts to overload a service and attempts to crash a host; and
    • Using or distributing tools designed to compromise security, such as password guessing programs, cracking tools, packet sniffers or network probing tools.

    Email Violations


    Shaw Business Services must not be used by any customer (or any of their customers) to send messages (including fax and voice traffic) that have the effect of preventing fair and proportionate use of Shaw Business Services by others. Other email violations include, but are not limited to:


    • advertising, transmitting, or in any way providing any software, program, product, or service that facilitates a violation of this AUP or is designed to violate the Shaw Business AUP or the AUP of any other Internet Service Provider.
    • sending unsolicited bulk messages, including, commercial advertising, unsolicited commercial messages, chain letters, charity requests, petitions for signatures and political or religious messages;
    • sending messages to any user who does not wish to receive it, either to a Shaw Business account holder or otherwise;
    • Spamming, whereby the customer sends numerous copies of the same or substantially similar messages to many account holders, or sending large or multiple files or messages to a single user with malicious intent;
    • Spamming indirectly through the use of other service providers or transmitting email or content through other service providers in a way which indicates in any way that Shaw Business was involved in the transmission of such email or content;
    • Altering the headers of email messages for the purpose of concealing the recipient's or sender's identity, or any other illegitimate purpose;
    • Operating an unsecured email relay;
    • Posting binary files to non binary newsgroups; and
    • Attempting to evade filters of spamming
  • Subscriber Agreement

    The customer will indemnify and hold Shaw Business harmless from any claim brought by third parties relating to the customer's use of Shaw Business Services. The customer must pay and defend all legal costs (including legal fees) arising from such claims. Upon receiving notice, the customer must immediately notify Shaw Business of any claim or potential claim involving their use of Shaw Business Services. Failure to do so gives Shaw Business the right to defend such claims at the customer's sole cost.


    Shaw Business makes no warranties of any kind, whether expressed or implied, including any implied warranty of merchantability or fitness of Shaw Business Services for a particular purpose. Shaw Business takes no responsibility for any direct, indirect, incidental, special, consequential, punitive or other damages whatsoever, including, but not limited to, loss of use, data, information or profits from delays, non-deliveries, mid-deliveries, or service interruptions, arising out of, or in connection with, customer use or access of any site.


    Shaw Business may co-operate with other Internet Service Providers to discourage and resist any abuse of online procedure and policies. In the event that Shaw Business learns that one of its customers is using other networks in an unacceptable way, Shaw Business reserves the right to take corrective action against such customer.

  • Content of Online Material

    Shaw Business is not responsible for, and shall not be held liable for any damages resultant of any conduct, content, communications, goods and services available on or through Shaw Business Services.

  • Privacy of Communications

    Shaw Business may at all times monitor the performance of Shaw Business Services electronically to ensure its facilities are operating properly.


    The customer acknowledges that Shaw Business has the right, but not the obligation, to monitor or disclose the contents of private communications if Shaw Business, in its sole discretion, reasonably believes that such action is necessary:


    1. to comply with applicable law or valid legal processes;
    2. to protect Shaw Business' rights or property;
    3. in emergencies where a person's physical safety is compromised; and
    4. to enforce the terms of this policy.

    Shaw Business is not obliged to inform the customer that such information has been disclosed or will be disclosed.

Terms of Use - Business WiFi

  • Introduction

    By using Shaw Business' wi-fi services and such other services (collectively, the "WiFi Services") provided by Shaw Cablesystems G.P., its partners and associates (collectively, "Shaw"), you (the "Customer") agree to the following terms and conditions of service. These Business WiFi Terms of Use govern Customer's use of the WiFi Services and any Shaw devices and/or equipment used to support the WiFi Services (collectively, the "Equipment") and are in addition to Shaw's Terms of Service, including the Acceptable Use Policy - Internet and Customer's Shaw Business Wifi Services Agreement (collectively, the "Agreement").

    Shaw may periodically revise this Agreement and will provide Customer with notice of any material changes by delivery to the address contained in the Shaw Business Wifi Services Agreement. CUSTOMER IS RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION PROVIDED AND POSTED ONLINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. NON-TERMINATION OR CONTINUED USE OF THE WIFI SERVICES AFTER CUSTOMER RECEIVES NOTIFICATION OF CHANGES CONSTITUTES CUSTOMER'S ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY SUCH CHANGES. If Customer does not agree with any of the amendments to this Agreement, Customer must stop using the WiFi Services and provide notice to Shaw of Customer's termination of this Agreement. In the event of conflict between any customer agreement and this Agreement, the terms of this Agreement will govern. Please refer to Customer agreement specific to the service which you are using. In the event of any conflict between these Terms of Use and the Acceptable Use Policy- Internet, these Terms of Use will govern.
  • Service Location & Provision of the WiFi Services
    Customer agrees to prepare the service location (the "Service Location") according to any instructions Shaw may give in advance of Shaw installing any equipment necessary to deliver the WiFi Services.

    Customer will provide Shaw with reasonable access to the Service Location and relevant communications infrastructure and provide any other information as reasonably requested by Shaw to enable installation, provisioning and delivery of the WiFi Services at the Service Location.

    Shaw cannot guarantee WiFi performance because performance at a Service Location is dependant on the number of access points supporting the WiFi Services, their location and the environment in which they are installed and any technical limitations applicable to the WiFi Services or Equipment.

    Shaw will try to provide the WiFi Services by date agreed with Customer, but all dates are estimates. If Shaw encounters delays imposed by Customer, or by unforeseeable circumstances, that impact the date agreed, Shaw may apply reasonable additional charges and/or claim a reasonable extension to any date previously agreed. Shaw will notify Customer in writing of any additional charges, which will be payable by Customer.
  • Equipment & Installation
    Shaw shall acquire, install, maintain and support all Equipment required to operate the WiFi Services. The Equipment does not include any end-user equipment, including, but not limited to, smart phones, tablets, laptops, gaming devices etc. Customer shall not tamper with or remove any Equipment from the Service Location without Shaw's written permission.
  • Service Support
    Customer agrees that Shaw will have sole authority to deal with the provision of the WiFi Services including the right to terminate Customer or an end-user's use of the WiFi Services without giving prior notice to Customer or end-user. After termination of an end-user's use, Shaw will use reasonable endeavours to inform Customer and explain its reasons for such a termination of access.
  • Customer Indemnity
    Customer shall indemnify, defend and hold harmless Shaw and its directors, officers, employees, agents, subsidiaries, affiliates, successors and assigns from and against any and all claims asserted by or on behalf of any end-user of the WiFi Services or arising out of the use of the WiFi Services.
  • Use of Shaw Name
    Customer may not use Shaw's name or any Shaw trademarks, trade names or service marks or other branding in connection with the marketing or provision of the WiFi Services or its operation of any WiFi hot spot(s) without the advance written consent of Shaw, which shall not be unreasonably withheld. Shaw may provide marketing materials to Customer to advertise the Service Location as a WiFi hot spot. Customer will use reasonable commercial efforts to use such marketing material within the Service Location.
  • Third Parties
    Customer acknowledges and understands that Shaw may use third parties to provide the WiFi Services or any or all of the components of the service, including without limitation installation, equipment, infrastructure, support or content. Shaw shall not be bound by any undertaking, representation or warranty made by third-party providers and suppliers in connection with the installation, maintenance or provision of the WiFi Services, if that undertaking, representation or warranty is inconsistent with the terms of the Agreement.
  • Limitation on Resale/Distribution
    Customer may not, without the prior written consent of Shaw, resell or otherwise make available the WiFi Services to any other wireless service provider.
  • Security and Abuse
    Customer understands and agrees that any activity listed as an illegal or prohibited activity in the Acceptable Use Policy - Internet may result in the termination of the WiFi Services to the Customer or the end-user or in the event of recurring violations termination of the WiFi Services to the Service Location.
